1 AGREEMENT TO TERMS

Please read these Terms and Conditions and agree to these terms and conditions before purchasing any of our products or services.  We always treat all our clients fairly and with respect, and would ask you to agree and accept these terms and conditions.

By registering or logging into our websites and using our services you confirm that you have read and agreed to these terms and conditions, and policies.

3 GENERAL

These Terms and Conditions shall apply to all documentation and services.  Nothing in these Terms and Conditions shall affect the Client’s statutory rights as a Consumer.

QMT & QMTP provide training, distance learning and e-learning training courses.  You can find a selection of these courses on our website www.qmt.co.uk.

4 INTELLECTUAL PROPERTY

The copyright and all intellectual property rights of our courses, the content of them and associated materials is owned solely by QMT and QMTP.  Unauthorised distribution or reproduction is forbidden. We supply these course materials for your use only, and you agree not to permit them to be used by any other person or for resale purposes.

All information provided is given in good faith and we will not be held responsible for actions taken by the client, any other individual or organisation as a result of the information provided during the training course.

We reserve the right to alter published courses and fees without prior notice.

5 THE ORDER

For e-learning courses – the order is made by enrolling online.  Your enrolment may be limited to the period specified for your e-learning course commencing on the date you enrolled.

For distance learning courses – you must contact help@qmt.co.uk to complete an application form and assessment will be made to determine the appropriate course level you need or an interview will be carried out virtually.

For training courses – you must book and pay for the training at least 30 days prior to the course start date, or immediately if the course starts sooner.

6 PAYMENT AND FEES

For e-learning courses – the fees in GBP shown on our website are inclusive of all taxes prevailing at the time.  These courses are purchased online only and payments for these courses are made in advance with no delivery charge.  Payments can be made by debit or credit card, using any of the following payment cards: MasterCard, Visa, American Express

For distance learning courses – payments must be made either by BACS or using debit or credit card.  You cannot make online payments for distance learning courses.  The course fees are specified in the application form.  All fees are subject to VAT at the prevailing rate.  Payments must be made in advance – based on a proforma invoice.  Payments can be made by either of the following methods:

BACS Transfer or Debit/Credit card

You must provide your telephone number to contact you for your payment card details.  We accept the following payment cards; MasterCard, Visa and American Express.

For training courses – payments must be received at least 30 days prior to the course start date, or immediately if the course starts sooner.  Cancellation of training courses can be made 30 days prior to course delivery date.  Payment for training courses must be made by BACS.  You cannot make online payments for the training courses.

If you have a payment issue, please contact help@qmt.co.uk promptly and provide all relevant details relating to your purchase.

7 DELIVERY

For e-learning courses – the delivery is on-line only, via access to written, video and downloadable material where appropriate.  Delivery of an e-learning course order shall be considered to be complete when we provide access to the course.

For distance learning courses – the delivery date is an estimate only.  The distance learning course material is delivered by couriers or Royal Mail Special Delivery, which need a signature on delivery.

For training courses – the delivery could be face to face or virtual.

8 CANELLATION & REFUNDS

All cancellations should be notified to QMT and QMTP in writing via email.

 For e-learning courses – you can cancel and receive a refund for your order within 14 days after the date of your purchase, as long as you have not accessed the course material.

For distance learning courses – you can return your (unused) course material in its original packaging, within 30 days after the date of your purchase.  A full refund will be given minus delivery cost.  After 30 days, there will be no refund or cancellation.

When you purchase a course, your enrolment on that course is personal to you and you may not transfer the course to any other person.  We may at our discretion be able to transfer the enrolment of the course to another student, but this will involve additional administration and registration fees.

For training courses – any cancellation must be made 30 days prior to course delivery date.

9 COMPLAINTS

11 DATA PROTECTION, SECURITY AND SITE USE

11.1 GDPR

We comply with all applicable data protection law whenever we handle personal data.  We are committed to protecting the privacy of those using our services and the confidentiality of the personal information that our candidates/clients provide us.  We always endeavour to make sure that the information we hold about our candidates/clients is accurate and up to date.  We will never pass on or sell personal information to third parties.

Your personal information is only used in accordance with GDPR for Data Protection Laws.  You must also comply with all applicable requirements of the Data Protection Laws.  You agree to our processing the personal data you provide.  You warrant that the data you provide will be accurate and if the data is not your own and you are applying on behalf of another person, for the purpose of the Data Protection Laws, you warrant that you have permission to provide us with the data.  In addition you agree that we are entitled to process the data for the permitted purposes.

For users that register on our websites (for e-learning courses), we also store the personal information they provide in their user profile.  All users can see, edit, or delete their personal information at any time (except they cannot change their username).

11.2 What rights you have over your data

If you have an account on our sites, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.  You can also request that we erase any personal data we hold about you.  This does not include any data we are obliged to keep for administrative, legal, or security purposes.

11.3 Embedded content from other websites

Articles on our sites may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website directly.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.  We do not store this information.

11.4 Cookies

If you leave a comment on our sites you may opt-in to saving your name, email address and website in cookies.  These are for your convenience so that you do not have to fill in your details again when you leave another comment.  These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies.  This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices.  Login cookies last for two days, and screen options cookies last for a year.  If you select “Remember Me”, your login will persist for two weeks.  If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser.  This cookie includes no personal data and simply indicates the post ID of the article you just edited.  It expires after 1 day.

11.5 Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

11.6 Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included.  Visitors to the website can download and extract any location data from images on the website.

11.7 Misuse

You must not misuse our websites by knowingly introducing: illegal, immoral, offensive, harmful or malicious content.  You must not attempt unauthorized access to our website as you would be committing a criminal offence under the Computer Misuse Act 1990.  Any such breach will be reported to the relevant authorities and we will cooperate with those authorities by disclosing your identity to them.  In the event of such a breach of the law and of this provision, your right to use our websites will cease immediately.

11.8 Viruses

We do not give any guarantee that our website will be secure or free from viruses.  You should make use of your own virus protection software and take responsibility for configuring your computer.

11.9 Third parties and backup services

We use a third party supplier (IONOS by 1&1) as our Internet Service Provider.  They host the web sites on their servers and provide backup and restore facilities.  We also back up our website and store the information locally.

12 LIABILITY

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.  We will under no circumstances be liable for:

Any loss of sales, profits, business opportunity or revenue

Loss or corruption of data, information or software

Any indirect or consequential loss

For e-learning courses if any fault or technical issue is found with a course, we will try rectification, where applicable. We will only provide a refund if the course is found to be defective to the point of not being fit for its purpose.

QMT & QMTP will not be liable for any failure or delay due to any force majeure event including acts of God, war, industrial disputes, accidents, pandemics, fire, flood, storm, explosion, acts of terrorism, national emergencies or any other cause beyond its reasonable control.

Also, we shall not be liable to you for your inability to access the online learning portal due to issues beyond our control, such as the speed of your modem, your security software or firewall or your internet service provider’s performance.

We try to ensure the accuracy of all our course materials, as reasonably possible, but we do not guarantee that the course materials will be error free.  We will not refund course fees on the basis that the course materials may not be free of errors, or up to date.

13 REVIEW OF TERMS

We review and may modify these Terms and Conditions from time to time to reflect changes in regulatory requirements and relevant laws. Every time you order Courses from us, the Terms and Conditions in effect at the time of your order will be the ones applicable.
